1. Agreement to Terms

By accessing and using Iberis Rental's website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. Iberis Rental reserves the right to make changes to this Terms of Use at any time and without notice. Your continued use of the website constitutes your acceptance of any updated terms.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Iberis Rental's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the materials
  • Use the materials for any commercial purpose or for any public display
  • Attempt to decompile or reverse engineer any software contained on the website
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server
  • Use any data mining, robots, or similar data gathering and extraction tools
  • Engage in any conduct that restricts or inhibits anyone's use of the website

3. Rental Agreement and Booking Terms

Deposit Requirements

A non-refundable deposit is required to secure all equipment reservations. Deposits must be received at least seven (7) days prior to the rental date. Bookings without required deposits will be automatically cancelled. Deposits are applied toward the total rental cost.

Booking Confirmation

Booking confirmation is sent only after payment of the deposit is received. Reservations are not confirmed until payment is processed. Customers will receive a confirmation email with booking details, equipment specifications, and pickup/delivery arrangements.

Rental Duration and Rates

Rental rates are based on the specified rental period. Rental periods begin at the pickup time and end at the return time. Late returns will be charged at the daily rate for each additional day. Customers are responsible for all equipment during the rental period.

Equipment Pickup and Delivery

Customers may arrange pickup or delivery. Pickup occurs at Iberis Rental's location in Hawkesbury, Ontario. Delivery fees are additional and will be quoted separately. Customers are responsible for accepting equipment at the scheduled time or arranging alternative arrangements.

4. Cancellation Policy

Cancellations must be submitted in writing at least seven (7) days before the rental date. Cancellations with more than 7 days notice: refund of 50% of total rental cost (minus non-refundable deposit). Cancellations with less than 7 days notice: no refund (deposit is forfeited). Cancellations within 48 hours of rental: full payment is due. No refunds for no-shows.

5. Damage and Liability

Responsibility for Equipment

Customers assume full responsibility for all rented equipment during the rental period. This includes protection from theft, loss, and damage. Customers are liable for all damage, including accidental damage, negligence, and misuse. See our Damage Policy for complete details on liability and charges.

Damage Charges

Customers will be charged for any damage to equipment. Charges include repair costs plus handling fees (10-30% depending on severity). Complete loss of equipment will be charged at full replacement cost. Damage charges are non-negotiable unless resolved through formal dispute processes.

Insurance

Customers may purchase optional damage waiver insurance at the time of booking. Damage waiver coverage does not apply to intentional damage, theft, or negligence. Details of coverage will be provided at the time of booking.

6. Acceptable Use Policy

You agree not to use our website or services in any manner that could damage, overburden, or impair our operations. You shall not:

  • Use equipment for any unlawful or prohibited purposes
  • Misrepresent yourself or provide false information in booking forms
  • Violate any applicable laws or regulations
  • Harass, abuse, or threaten Iberis staff or other customers
  • Attempt to gain unauthorized access to our systems
  • Use the website for commercial purposes without authorization
  • Engage in any form of fraudulent activity
  • Use equipment in a manner that violates the Damage Policy

7. Disclaimer of Warranties and Limitation of Liability

As-Is Basis

The materials on Iberis Rental's website are provided on an 'as is' basis. Iberis makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Equipment Condition

All rented equipment is provided in good working condition. However, Iberis is not liable for any malfunctions or defects that may occur during use. Customers should inspect equipment upon receipt and report any issues immediately.

Limitation of Liability

In no event shall Iberis Rental, its directors, employees, or agents be liable to you for any damages, including lost profits, lost revenue, lost data, or other damages arising from your use of or inability to use the materials on the website or services provided.

8. Termination of Use

Iberis Rental may terminate or suspend your access to the website and services at any time, without notice, if you violate these Terms of Use, engage in fraudulent activity, or pose a risk to the company or other customers. Grounds for termination include but are not limited to non-payment, repeated damage violations, or abusive conduct.

9. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of Ontario, Canada, and you irrevocably submit to the exclusive jurisdiction of the courts located in Ontario.

10. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms of Use or rental services shall be resolved through the following process:

  1. Informal Resolution: Parties agree to attempt good faith negotiation for 30 days
  2. Mediation: If unresolved, disputes may be submitted to mediation
  3. Arbitration: If mediation fails, disputes shall be submitted to binding arbitration
  4. Legal Action: Either party may pursue legal action if arbitration is unsuccessful

11. Indemnification

You agree to indemnify and hold harmless Iberis Rental and its officers, directors, and employees from any claims, damages, losses, or expenses (including attorney fees) arising from your use of our services, violation of these Terms of Use, or violation of any rights of another party.

12. Severability

If any part of these terms of use is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining portions will continue in full force and effect.

13. Changes to Terms

Iberis Rental reserves the right to change these terms and conditions at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the website and services constitutes acceptance of any changes. Significant changes affecting rental policies will be communicated directly to customers.
